This Privacy Policy describes how Casual Criminalist (“we”, “us”, “our”), operated by Fulcrum Enterprises IV s.r.o., collects, uses, discloses, and protects your personal data when you access or use the website at https://casualcriminalist.channel (the “Site”), including free editorial content, newsletter sign-ups, and purchases from the Casual Criminalist merchandise store.

1. Who We Are (Data Controller)

Registered with the Municipal Court in Prague, C-insert (C 414319) under the transformation from Fulcrum Enterprises s.r.o. as of 1 January 2024.

We are the data controller for all personal data processed via the Site. For legal or privacy questions, contact us at contact@casualcriminalist.channel.

2. What Data We Collect

  • — Newsletter & contact data. Name (if provided), email address, consent timestamp, and IP address at the time of sign-up.
  • — Merchandise order data. When you place an order in the Casual Criminalist store, we collect your shipping address, phone number (for delivery), and the contents and status of your order.
  • — Merchandise payment data. Handled by Fourthwall (our merchandise storefront and fulfillment provider). Card details are processed by Fourthwall's payment processors and not stored by us.
  • — Technical / usage data. IP address, device and browser type, pages viewed, timestamps, referrer URLs.
  • — Cookies. Essential cookies for site operation; optional analytics cookies (if consented).
  • — Communications & support. Messages, emails, or support requests you send us.

3. Legal Bases for Processing (GDPR)

We process your data because:

  • — Contractual necessity. To process merchandise orders and deliver goods you have purchased.
  • — Legitimate interests. To secure the Site, analyze usage, detect abuse / fraud, and improve the service.
  • — Legal obligations. For accounting, tax, and regulatory compliance.
  • — Consent. For newsletter sign-ups, optional analytics, and any marketing communications beyond order-related messages.

4. How We Use Your Data

  • — Delivering, maintaining, and updating the Site.
  • — Processing merchandise orders (via Fourthwall), including fulfillment, shipping, and post-purchase support.
  • — Sending transactional / order-related emails (order confirmations, shipping updates, support replies).
  • — Sending newsletters and notifications you have opted into. You may opt out at any time.
  • — Monitoring and optimizing performance, security, and user experience.

5. Disclosure, Sharing & Transfers

  • — Fourthwall, Inc. Operates the Casual Criminalist merchandise store, processes orders, and handles fulfillment, shipping, and merchandise customer support on our behalf.
  • — Third-party service providers. Hosting, analytics, email delivery, caching, and support tools — all under data-processing agreements.
  • — Legal / regulatory authorities. If required by law or to enforce our rights.

Some providers operate outside the EEA. In such cases, we rely on EU Commission adequacy decisions or standard contractual clauses to protect your personal data.

6. Data Retention

  • — Order & billing records. Retained for up to 10 years after the order, in line with Czech tax law.
  • — Newsletter sign-ups. Retained for as long as you remain subscribed, plus the period necessary to evidence your consent.
  • — Technical logs & analytics. Retained for up to 12 months, then anonymized where possible.
  • — Communications & support records. Kept as long as necessary to resolve issues or legal claims.

7. Your Rights (Under GDPR / Czech Law)

You can:

  • — Access your personal data.
  • — Request correction of inaccuracies.
  • — Ask for erasure (delete) of your data, subject to legal constraints.
  • — Request restriction of, or object to, processing.
  • — Receive your data in a portable format.
  • — Withdraw consent at any time (without affecting processing done before withdrawal).
  • — Lodge a complaint with the Czech Office for Personal Data Protection (Úřad pro ochranu osobních údajů).

8. California Residents (CCPA)

If you are a California resident, the California Consumer Privacy Act (CCPA) gives you rights with respect to the personal information we collect about you. These rights overlap substantially with the GDPR-style rights listed above, and include the right to know, the right to access and portability, the right to correct, and the right to delete your personal information.

In addition, the CCPA gives you the right to opt out of any “sale” or “sharing” of your personal information. We do not sell personal information for money. To the extent any of our advertising or analytics integrations are considered “sharing” for cross-context behavioral advertising under the CCPA, you can opt out by emailing contact@casualcriminalist.channel or by enabling the Global Privacy Control signal in your browser (see below).

California's “Shine the Light” law: we do not disclose your personal information to third parties for their own direct marketing purposes.

To submit a CCPA request or ask a question about your California privacy rights, email contact@casualcriminalist.channel. We may ask for information to verify your identity before responding.

9. Children's Privacy

The Site is not directed to children. We do not knowingly collect personal information from anyone under 16 (the threshold under the GDPR) or under 13 (the threshold under the U.S. Children's Online Privacy Protection Act). If you believe a child has provided us with personal information, contact us at contact@casualcriminalist.channel and we will delete it.

10. Cookies & Tracking

We employ:

  • — Necessary cookies. Strictly required for site functionality.
  • — Analytics cookies. For aggregated usage and performance metrics (where you have given consent).

You may disable or manage cookies via your browser settings, or via the Cookie Preferences link in the site footer. Disabling essential cookies may limit Site functionality.

We honor the Global Privacy Control (GPC) signal as a valid opt-out request for any processing that would otherwise be treated as “sale” or “sharing” of personal information under the CCPA. We do not currently respond to legacy Do Not Track (DNT) browser headers because no consensus standard for DNT exists; please use GPC instead.

11. Changes to This Policy

We may update this policy periodically. When we do, we will post the revised version on this page with an updated “Last updated” date. For material changes, we may notify users by email.
